Terms of Service

1. Agreement to Terms

By accessing or using MuseOn ("Service"), operated by Museon AI, Inc. ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

MuseOn is a social media content creation and management platform that provides tools for content generation, scheduling, publishing, and analytics across multiple social media platforms. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

  • Maintaining the confidentiality of your account and password
  • Restricting access to your account
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the intellectual property rights of others
  • Distribute spam, malware, or other harmful content
  • Impersonate any person or entity
  • Harass, abuse, or harm another person
  • Collect user information without consent
  • Interfere with the proper functioning of the Service
  • Attempt to gain unauthorized access to systems or networks
  • Create content that is illegal, defamatory, or obscene
  • Violate the terms of service of connected social media platforms

5. Content Ownership and Rights

Your Content: You retain ownership of any content you create, upload, or share through the Service. By using our Service, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely for the purpose of providing the Service.

Our Content: The Service and its original content (excluding user-generated content), features, and functionality are owned by MuseOn and are protected by international copyright, trademark, and other intellectual property laws.

6. AI-Generated Content

Our Service uses artificial intelligence to generate content. You acknowledge and agree that:

  • AI-generated content may not always be accurate or appropriate
  • You are responsible for reviewing and approving all content before publishing
  • You will not use AI-generated content for illegal or harmful purposes
  • Ownership of AI-generated content created through your use of the Service belongs to you

7. Third-Party Integrations

The Service integrates with third-party social media platforms. Your use of these integrations is subject to the terms and policies of those platforms. We are not responsible for any actions taken by these third parties, including account suspensions or content removal.

8. Payment and Billing

If you purchase a subscription or other paid features:

  • You agree to pay all fees associated with your selected plan
  • We may change our fees upon 30 days' notice
  • Your subscription will automatically renew unless cancelled
  • You can cancel your subscription at any time through your account settings

9. Refund Policy

We strive to ensure customer satisfaction with our service. The following refund terms apply:

9.1 Subscription Plans

Monthly Subscriptions: You may cancel your monthly subscription at any time. Upon cancellation, you will continue to have access to the service until the end of your current billing period. Refunds for partial months are not provided.

Annual Subscriptions: If you cancel within 14 days of your initial purchase or renewal, you may request a full refund. After 14 days, you will continue to have access until the end of your annual billing period, but no refund will be issued.

9.2 AI Credits and Add-on Purchases

AI Credits and add-on credit packs are non-refundable once purchased, as they are immediately available for use upon purchase. We encourage you to start with smaller credit packs to evaluate the service before making larger purchases.

Exception: If you experience a technical issue that prevents you from using your purchased credits, please contact our support team within 7 days of purchase. We will investigate and may issue a refund or credit at our discretion.

9.3 How to Request a Refund

To request a refund, please contact our support team at [email protected] with the following information:

  • Your account email address
  • Date of purchase
  • Order/transaction ID (if available)
  • Reason for the refund request

9.4 Refund Processing

Once we receive your refund request, we will review it within 5-7 business days. If approved:

  • Refunds will be processed to the original payment method
  • Credit/debit card refunds may take 5-10 business days to appear on your statement
  • You will receive an email confirmation once the refund is processed

9.5 Chargebacks

We encourage you to contact us directly before initiating a chargeback with your bank or credit card company. We are committed to resolving any issues fairly and promptly. Initiating a chargeback without first contacting us may result in the suspension of your account.

9.6 Refund Exceptions

Refunds may be denied in the following circumstances:

  • Violation of our Terms of Service
  • Fraudulent activity or abuse of our refund policy
  • Requests made outside the applicable refund window
  • Promotional or discounted purchases (unless otherwise stated)

10. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by contacting us or through your account settings.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUSEON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

13. Indemnification

You agree to defend, indemnify, and hold harmless MuseOn and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Delaware.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
